At this point, the following motion will be moved by the Chair:

 

“That, pursuant to Section 100A of the Local Government Act 1972 (as amended) members of the press and public be excluded during consideration of the following items on the agenda, as it is likely that there would be disclosure of exempt information as defined in the relevant paragraphs of Part 1 of Schedule 12A of that Act”

Resolved –

That, pursuant to Section 100A of the Local Government Act 1972 (as amended), members of the press and public be excluded during consideration of the following item of business as it was likely that there would be disclosures of exempt information as defined in paragraphs 1, 2 and 3, specified in Part 1 of Schedule 12A (as amended) to that Act.

Applications for the Grant, Renewal, Suspension or Revocation of Hackney Carriage and Private Hire Vehicle Driver Licences and Appeals against the Allocation of Penalty Points on Private Hire Vehicle Driver's Licence

The Director of Environment and Neighbourhood Services submitted a report asking the Sub-Committee to consider an application for the grant of private hire vehicle driver’s licence, the consideration of the suspension or revocation of a hackney carriage vehicle driver’s licence and an appeal against penalty points allocated to a private hire vehicle driver’s licence.

A summary of the circumstances of each case was appended to the report.

HSA and ZAR were both present at the meeting and addressed the Sub-Committee. 

LM was not present at the meeting and had requested that his case be adjourned.

Resolved –

(1)     That, with the consent of ZAR, consideration of the suspension or revocation of ZAR’s hackney carriage vehicle driver’s licence be deferred to the next meeting of the Sub-Committee.

(2)     That the application in respect of HSA for the grant of a three year private hire vehicle driver’s licence be refused due to the Sub-Committee not considering him to be a fit and proper person to hold such a licence and by reason of:

(a)     the nature of the offence, as detailed in the report;

(b)     the requirement of the Sub-Committee to comply with the provisions of the Safeguarding Vulnerable Groups Act;

HSA was advised of his right of appeal;

(3)     That the appeal by LM against the allocation of penalty points to a private hire vehicle driver’s licence be deferred to the next meeting of the Sub-Committee to allow the applicant to attend and on the basis that the appeal would be determined at the next meeting whether or not the appellant was in attendance;
