The Minutes of the meeting held on 6 February 2020 were confirmed as a correct record and signed by the Chair.

Exclusion of Press and Public

At this point, the following motion will be moved by the Chair:

 

“That, pursuant to Section 100A of the Local Government Act 1972 (as amended) members of the press and public be excluded during consideration of the following items on the agenda, as it is likely that there would be disclosure of exempt information as defined in the relevant paragraphs of Part 1 of Schedule 12A of that Act”

Minutes:

That, pursuant to Section 100A of the Local Government Act 1972 (as amended), members of the press and public be excluded during consideration of the following item of business as it was likely that there would be disclosures of exempt information as defined in paragraphs 1, 2 and 3, specified in Part 1 of Schedule 12A (as amended) to that Act.

Applications for the Grant, Renewal, Suspension or Revocation of Hackney Carriage and Private Hire Vehicle Driver Licences and Appeals against the Allocation of Penalty Points on Private Hire Vehicle Driver's Licence

Consideration of Vehicle Driver’s Licences.

Minutes:

(1)           That the application in respect of KZA for the grant of a three year school transport vehicle driver’s licence be refused due to the Sub-Committee not considering him to be a fit and proper person to hold such a licence by reason of:

(a)     the pattern and nature of previous offences, as detailed in the report;

(b)     that KZA had not disclosed on his current application that he had previously had a licence revoked by another local authority;

(c)     the Sub-Committee not being convinced that KZA had demonstrated he had been rehabiliated;

(d)     the Sub-Committee not being confident that KZA would safeguard the children in his care;

(e)     KZA was advised of his right of appeal;

(2)           That the private hire vehicle driver’s licence in respect of LMS be revoked with immediate effect due to the Sub-Committee not considering him to be a fit and proper person to hold such a licence and due to the following reasonable causes pursuant to section 61 of the Local Government (Miscellaneous Provisions) Act 1976:

(a)     the nature of the alleged incidents, as detailed in the report;

(b)     concern over the safety of the public if LMS continued to hold such a licence given the circumstances of the alleged incidents;

(c)     the breach of condition 13.8 of Section 13 of the Private Hire Driver Conditions;

(d)     the breach of licence conditions, as detailed in the report;

(3)     That the appeal by SN against the allocation of six penalty points on his private hire vehicle driver’s licence be refused;

(4)     That the appeal by SH against the allocation of twelve penalty points on his private hire vehicle driver’s licence be refused.
