The Minutes of the meeting held on 4 November 2021 were confirmed as a correct record.

Exclusion of Press and Public

At this point, the following motion will be moved by the Chair:

 

“That, pursuant to Section 100A of the Local Government Act 1972 (as amended) members of the press and public be excluded during consideration of the following items on the agenda, as it is likely that there would be disclosure of exempt information as defined in the relevant paragraphs of Part 1 of Schedule 12A of that Act”

Resolved –

That, pursuant to Section 100A of the Local Government Act 1972 (as amended), members of the press and public be excluded during consideration of the following item of business as it was likely that there would be disclosures of exempt information as defined in paragraphs 1, 2, 3 and 5 specified in Part 1 of Schedule 12A (as amended) to that Act.

Applications for the Grant, Renewal, Suspension or Revocation of Hackney Carriage and Private Hire Vehicle Driver Licences and Appeals against the Allocation of Penalty Points on Private Hire Vehicle Driver's Licence

Minutes:

The Executive Director of Economic Growth and Neighbourhood Services submitted a report asking the Sub-Committee to consider the suspension or revocation of two Private Hire Vehicle driver’s licences and an appeal against penalty points allocated to a Private Hire Vehicle driver’s licence.

A summary of the circumstances of each of the cases was appended to the report.

RBS was not present at the meeting and had sent an e-mail to Licensing officers explaining that he was too unwell to attend.  The Sub-Committee noted that this case had been deferred from the meeting held on 4 November 2021 when the driver had also been too unwell to attend, and that the driver had been informed at that time that the case could be heard in his absence if he did not attend this meeting.

AP was present at the meeting, addressed the Sub-Committee and responded to questions.

MSM was not present at the meeting and had sent an e-mail to Licensing officers explaining that he was too unwell to attend.

Resolved –

(1)      That the review of the Private Hire Vehicle driver’s licence held by RBS be heard in his absence as the Sub-Committee considered the review should be carried out in a timely fashion;

(2)      That the private hire vehicle driver’s licence in respect of RBS be revoked with immediate effect due to the Sub-Committee not considering him to be a fit and proper person to hold such a licence and due to the following reasonable causes pursuant to section 61 (1) (b) of the Local Government (Miscellaneous Provisions) Act 1976:

(a)     the nature of the alleged incidents, as detailed in the report;

(b)     concern over the safety of the public if RBS continued to hold such a licence given the circumstances of the alleged incidents;

(c)      the breach of the Private Hire Driver Conditions, as detailed in the report.

(3)      That the private hire vehicle driver’s licence in respect of AP be suspended for a period of four weeks with immediate effect due to the following reasonable causes pursuant to section 61 (1) (b) of the Local Government (Miscellaneous Provisions) Act 1976:

(a)     the nature of the alleged incidents, as detailed in the report;

(b)     concern over the safety of the public;

(4)      That the appeal against the allocation of penalty points to the Private Hire Vehicle driver’s licence in respect of MSM be deferred to the next meeting of the Sub-Committee on 11 January 2022.
