To confirm the Minutes of the Licensing Applications Sub-Committee 3 meeting held on 6 April 2022.

The Minutes of the meeting held on 6 April 2022 were confirmed as a correct record and signed by the Chair.

Exclusion of Press and Public

At this point, the following motion will be moved by the Chair:

 

“That, pursuant to Section 100A of the Local Government Act 1972 (as amended) members of the press and public be excluded during consideration of the following items on the agenda, as it is likely that there would be disclosure of exempt information as defined in the relevant paragraphs of Part 1 of Schedule 12A of that Act”

Resolved –

 

That, pursuant to Section 100A of the Local Government Act 1972 (as amended), members of the press and public be excluded during consideration of the following item of business as it was likely that there would be disclosures of exempt information as defined in paragraphs 1, 2, 3 and 5 specified in Part 1 of Schedule 12A (as amended) to that Act.

Applications for the Grant, Renewal, Suspension or Revocation of Hackney Carriage and Private Hire Vehicle Driver Licences and Appeals against the Allocation of Penalty Points on Private Hire Vehicle Driver's Licence

Minutes:

The Executive Director of Economic Growth and Neighbourhood Services submitted a report asking the Sub-Committee to consider an application for the grant of a Private Hire (School Transport) Vehicle Driver’s Licence, the suspension or revocation of a hackney carriage vehicle driver’s licence and an appeal against allocation of penalty points on a private hire vehicle driver’s licence.

 

A summary of the circumstances of the cases was appended to the report.

 

MBSK was present at the meeting. She was accompanied by her daughter and Alan Parkinson of Green Metro Cars. MBSK and Alan Parkinson both addressed the Sub-Committee and responded to questions.

 

ES was also present at the meeting. He was accompanied by Mr Erdar who assisted with translation. Both addressed the Sub-Committee and responded to questions.

 

SMRA was not present at the meeting and had sent an email to Licensing officers explaining that he unable to attend due to a family bereavement and requesting a deferral.

 

Resolved –

 

(1)           That the application by MBSK for the grant of a three-year School Transport Vehicle Driver’s Licence be granted for a period of one year, with a warning as to future conduct, and that the Assistant Director of Planning, Transport and Public Protection be authorised to renew the licence for a further two years, subject to no breaches of licence conditions, offences being committed, or complaints being received;

 

(2)           That the hackney carriage driver's licence in respect of ES be suspended for the period of 7 days with effect from the end of 21 days notice of the decision being given to the driver due to the following reasonable causes pursuant to section 61 (1) (b) of the Local Government (Miscellaneous Provisions) Act 1976:

 

(a)            the nature of the offences, as detailed in the report;

 

(b)           breaches of licence conditions, as detailed in the report.

 

ES was advised of his right of appeal;

 

(3)           That the appeal against the allocation of penalty points to the Private Hire Vehicle driver’s licence in respect of SMRA be deferred to the meeting of the Sub-Committee on 29 September 2022.
