The Minutes of the meeting of Licensing Applications Sub-Committee 2 held on 25 July 2019 were confirmed as a correct record and signed by theChair.

Exclusion of Press and Public

To consider whether to exclude the public from all or part of the hearing under Regulation 14(2) of the Licensing Act 2003 (Hearings) Regulations 2005.

Minutes:

That, pursuant to Section 100A of the Local Government Act 1972 (as amended) members of the press and public be excluded during consideration of Item 6 below, as it was likely that there would be disclosure of exempt information as defined in paragraphs 3 and 6B of Part 1 of Schedule 12A of that Act.

Appeal Decision Review

Minutes:

The Executive Director of Economic Growth and Neighbourhood Services submitted a report which presented the history of the premises known as Simply Fresh Supermarket, 236-240 Northumberland Avenue, Reading, RG2 7QA, detailing the review and revocation of the premises licence by the Licensing Applications Committee and appeal in the Magistrates’ Court and the proposed settlement offer.

 

The report asked the Licensing Committee to note the history of the premises and decide whether to continue to defend the decision to revoke the premises licence in the Magistrates’ Court.

 

Resolved –

 

(1)     That the history of this premises licence and proposed offer of settlement from the premises licence holder be noted;

 

(2)     That the Council continue to defend the decision to revoke the premises licence;

 

(3)     That the Principal Licensing and Enforcement Officer be authorised to respond in writing confirming the Council’s decision to continue with the appeal proceedings;

 

(4)     That, in accordance with paragraph 5.2 of the report, the Principal Licensing and Enforcement Officer inform the premises licence holder in writing that if they agree to withdraw their appeal the Council would not claim any costs in relation to their preparation of the response to the appeal.
