The Executive Director of Economic Growth and Neighbourhood Services submitted a report asking the Sub-Committee to consider the suspension or revocation of a Private Hire Vehicle driver’s licence and an appeal against penalty points allocated to a Private Hire Vehicle driver’s licence.

A summary of the circumstances of each of the cases was appended to the report.

FY was present at the meeting, addressed the Sub-Committee and responded to questions.  AP also attended the meeting to support FY and answered questions.

Councillor Rowland left the meeting after consideration of FY’s case and took no part in consideration of MSM’s case.

MSM was present at the meeting, addressed the Sub-Committee and responded to questions.

Resolved –

(1)      That the Private Hire Vehicle Driver’s licence in respect of FY be revoked with immediate effect due to the Sub-Committee not considering him to be a fit and proper person to hold such a licence and due to the following reasonable causes pursuant to section 61 (1) (b) of the Local Government (Miscellaneous Provisions) Act 1976:

(a)     the nature of the alleged incidents, as detailed in the report;

(b)     concern over the safety of the public;

(c)      the breach of the Private Hire Driver Conditions, as detailed in the report.

(2)      That the appeal against the allocation of penalty points to the Private Hire Vehicle driver’s licence in respect of MSM be refused due to the breach of Private Hire Driver Conditions, as detailed in the report.  It had been found that the licence holder had been in breach of Condition 26.1 of the Private Hire Vehicles driver conditions in that they had been plying for hire during a test purchase operation, and as a consequence the addition of 12 penalty points to the driver’s licence should stand.
