Minutes:

The Director of Environment and Neighbourhood Services submitted a report asking the Sub-Committee to consider the suspension or revocation of a private hire vehicle driver’s licence.

A summary of the circumstances of the case was appended to the report.

The Sub-Committee noted that AQS had failed to attend the previous hearing and had not notified the council of his intended absence.  As a consequence the meeting had been deferred to 10 April 2019.  A letter had been sent to AQS advising him of the hearing scheduled for 10 April 2019 and informed him that the application would be heard in his absence should he fail to attend.  As AQS did not attend the application was heard in his absence on the basis of the written representations submitted.

Resolved –

That the private hire vehicle licence in respect of AQS be revoked with immediate effect in the interests of public safety and for the following reasonable causes pursuant to section 61 of the Local Government (Miscellaneous Provisions) Act 1976:

(a)     the nature of his offences, as detailed in the report;

(b)     insufficient time had elapsed since the convictions for some offences, as detailed in the report;

(c)      the breaches of licence conditions, traffic regulations and legislation, as detailed in the report;

(d)     the issue of public safety given the circumstances of the incident.
