To confirm the Minutes of the Licensing Applications Sub-Committee 3 meeting held on 1 August 2018.

The Minutes of the meeting held on 1 August 2018 were confirmed as a correct record and signed by the Chair.

At this point, the following motion will be moved by the Chair:

 

“That, pursuant to Section 100A of the Local Government Act 1972 (as amended) members of the press and public be excluded during consideration of the following items on the agenda, as it is likely that there would be disclosure of exempt information as defined in the relevant paragraphs of Part 1 of Schedule 12A of that Act”

Resolved –

That, pursuant to Section 100A of the Local Government Act 1972 (as amended), members of the press and public be excluded during consideration of the following item of business as it was likely that there would be disclosures of exempt information as defined in paragraphs 1, 2, 3 and 5, specified in Part 1 of Schedule 12A (as amended) to that Act.

Applications for the Grant, Renewal, Suspension or Revocation of Hackney Carriage and Private Hire Vehicle Driver Licences and Appeals against the Allocation of Penalty Points on Private Hire Vehicle Driver's Licence

The Director of Environment and Neighbourhood Services submitted a report asking the Sub-Committee to consider an application for the for the grant of a licence to drive a private hire vehicle, two applications for consideration of the suspension or revocation of Hackney Carriage Vehicle Drivers’ Licences, and an appeal against the allocation of penalty points

A summary of the circumstances of each case was appended to the report.

AA was present at the meeting and was accompanied by Mr MH. Both addressed the Sub-Committee and responded to questions. 

MN was present at the meeting and was accompanied by Mr AR. Both addressed the Sub-Committee and responded to questions.

MSB was present at the meeting and was represented by Mr Sotiris Yiakoumi, Solicitor. Both addressed the Sub-Committee and responded to questions.

HRS was not present at the meeting and the Sub-Committee agreed to determine the appeal in his absence on the basis of the written representations submitted.

Resolved –

(1)      That the application by AA for the grant of a Private Hire Vehicle Driver’s Licence be granted for three months, with a warning as to future conduct, and the Head of Planning, Development and Regulatory Services be authorised to renew the licence for three further periods of three months, subject to no breaches of licence conditions, offences being committed or complaints being received, and thereafter for a period of two further years, subject to no breaches of licence conditions, offences being committed or complaints being received;

(2)      That the Hackney Carriage Vehicle Driver’s Licence in respect of MN remain in force;

(3)      That the Hackney Carriage Vehicle Driver’s Licence in respect of MSB remain in force, with a warning as to future conduct;

(4)      That the appeal by HRS against the allocation of penalty points to a Private Hire Vehicle Driver’s Licence be dismissed and the officers’ decision be upheld.
