The Minutes of the meeting held on 7 February 2019 were confirmed as a correct record and signed by the Chair.

Exclusion of Press and Public

At this point, the following motion will be moved by the Chair:

 

“That, pursuant to Section 100A of the Local Government Act 1972 (as amended) members of the press and public be excluded during consideration of the following items on the agenda, as it is likely that there would be disclosure of exempt information as defined in the relevant paragraphs of Part 1 of Schedule 12A of that Act”

Resolved –

That, pursuant to Section 100A of the Local Government Act 1972 (as amended), members of the press and public be excluded during consideration of the following item of business as it was likely that there would be disclosures of exempt information as defined in paragraphs 1, 2 and 3, specified in Part 1 of Schedule 12A (as amended) to that Act.

Applications for the Grant, Renewal, Suspension or Revocation of Hackney Carriage and Private Hire Vehicle Driver Licences and Appeals against the Allocation of Penalty Points on Private Hire Vehicle Driver's Licence

Minutes:

The Director of Environment and Neighbourhood Services submitted a report asking the Sub-Committee to consider an application for the grant of a hackney carriage vehicle driver’s licence, an application for the grant of a private hire vehicle driver’s licence, the renewal of a private hire vehicle driver’s licence and the consideration of the suspension or revocation of two private hire vehicle driver’s licences.

A summary of the circumstances of each case was appended to the report.

NA, KB, AGK, and DAP were all present at the meeting and addressed the Sub-Committee.  KB was accompanied by his friend, Mr Farooq, and AGK was accompanied by his wife.   

AQS was not present at the meeting.

Resolved –

(1)      That the application in respect of NA for the grant of a three year hackney carriage vehicle driver’s licence be refused due to the Sub-Committee not considering him to be a fit and proper person to hold such a licence for the following reasons:

          (a)      the nature of the offences, as detailed in the report;

         

(b)      insufficient time had elapsed since the convictions for some offences, as detailed in the report;

 

NA was advised of his right of appeal;

(2)      That the application in respect of KB for the grant of a three year private hire vehicle driver’s licence be refused due to the Sub-Committee not considering him to be a fit and proper person to hold such a licence for the following reasons:

          (a)      the nature of the offences, as detailed in the report;

         

(b)      insufficient time had elapsed since the convictions for some offences, as detailed in the report;

 

(c)      the breaches of licence conditions, traffic regulations and legislation, as detailed in the report;

 

KB was advised of his right of appeal;

(3)      That the application in respect of AGK for the renewal of a three year private hire vehicle driver’s licence be refused due to the Sub-Committee not considering him to be a fit and proper person to hold such a licence and due to the following reasonable causes pursuant to section 61 of the Local Government (Miscellaneous Provisions) Act 1976:

          (a)      the nature of the offences, as detailed in the report;

         

(b)      that the applicant remains on the Data and Barring Service (DBS) Children’s Barred List, and this employment was a regulated activity;

 

AGK was advised of his right of appeal;

(4)      That the consideration of the suspension or revocation of the private hire vehicle driver’s licence in respect of AQS be deferred to the next meeting of the Sub-Committee;

(5)      That the private hire vehicle driver’s licence in respect of DAP remain in force, with a warning as to future conduct.
