The Minutes of the meeting of Licensing Applications Sub-Committee 1 held on 9 November 2021 were confirmed as a correct record subject to the following amendments:

Paragraphs 4 and 6 – delete the word “review”

and

Paragraph 7 – delete and replace with

“The Licensing authority, when determining an application for the grant of a premises licence may:

·       Grant the application as applied for;

·       Grant the application with modifications;

·       Refuse the application.”

The Deputy Director of Planning, Transport and Regulatory Services submitted a report on an application for the grant of a Premises Licence in respect of Boom Battle Bar, The Oracle, Unit No L30, Lower Level, Minster Street/Gun Street, Reading, RG1 2AG.

The report stated that the application was for the grant of a premises licence to permit the following licensable activities:

Sale of Alcohol

Monday to Thursday from 1200hrs until 0000hrs

Friday to Saturday from 1200hrs to 0130hrs

Sunday from 1200hrs to 2330hrs

Late Night Refreshment

Monday to Thursday from 2300hrs until 0000hrs

Friday to Saturday from 2300hrs to 0130hrs

Sunday from 2300hrs to 0000hrs

Indoor Sporting Events

Monday to Thursday from 1200hrs until 0000hrs

Friday to Saturday from 1200hrs to 0130hrs

Sunday from 1200hrs to 0000hrs

Recorded Music

Monday to Thursday from 1200hrs until 0000hrs

Friday to Saturday from 1200hrs to 0130hrs

Sunday from 1200hrs to 0000hrs

Opening Hours

Monday to Thursday from 1200hrs until 0000hrs

A copy of the application form and proposed conditions were attached to the report at Appendix DF1.

During the 28-day consultation period for the application, representations had been received by Reading Borough Council, which were attached to the report at Appendices DF2.  The representations made by the Responsible Authorities had been withdrawn following agreement of a set of draft conditions and adjusted hours, which were attached to the report at Appendix DF3.

The report stated that in determining the application the Licensing Authority had a duty to carry out its functions with a view to promoting the four licensing objectives, as follows:

  • The prevention of crime and disorder;
  • Public safety;
  • The prevention of public nuisance;
  • The protection of children from harm.

The report further stated that in determining the application the Licensing Authority must also have regard to the representations received, the Licensing Authority’s statement of licensing policy and any relevant section of the statutory guidance to licensing authorities.  Furthermore, in determining the application, the Licensing Authority could take such of the following steps as it considered appropriate and proportionate for the promotion of the licensing objectives:

·      Grant the application as applied for;

·       Grant the application with modifications;

·       Refuse the application.”

The report set out paragraphs 1.5, 8.41 to 8.49, 9.111 to 9.13 and 14.63 to 14.659.43 from the Secretary of State’s Guidance to the Licensing Act 2003 issued in April 2018.  The report also set out paragraphs 7.1, 7.15.1 and 11.4.1 of the Council’s Statement of Licensing Policy.

Rishpal Singh, owner of BBB Reading, Allan Cook, Head of Operations and Marcus Lavell, Legal Adviser to the Applicant attended the meeting, addressed the Sub-Committee on the application and responded to questions.  Objector Laura Grantham, Sales Manager, Premier Suites attended the meeting and addressed the Sub-Committee on the application.

Dan Fundrey, Licensing Enforcement Officer, presented the report at the meeting.
